Whereas in the management of some group pension funds, the multiplicity and complexity of the various schemes and their close connexxxxx xxxx xxxxxx xxxxxxxx xxxxxxx xxxx xxx xxxxxxx xxxxxx xxxxxxx xxxx xxxxxx xxxxxxxxx xx xxxxxxxx xxxx xxx xxxxx xx xxx xxxxxxxxxx xxxxxxxx xx xxxxxxx xx xxxxxxx xxxxxxxx xxxxxxxxx xx xxxx xxxxxxxxxx xxxxxxx xxxx xxxx xxxx xxx xxxxxxx xxxxxx xx xxxxxxx xxxxxxxxxx

Whereas the taking-up and pursuit of acxxxxxx xx xxx xx xxxxxxx xx xxxxxxx xxxxxxxx xxxxxx xx xxxxxxx xx xxxxxxxxxx xxxxxxxxxxxx xxx xxxxxxxxx xxxxxxxxxxxxxxxxxx xxxxxxxxxx xxxx xxxxxxxxns regarding financial guarantees, conditions of assurance and premium rates; whereas those procedures may be relaxed where the activity pursued by wxx xx xxxxxxx xx xxxxxxx xxxxxxxx xxxxxx xxxxxxxxxxxxxx xxxx xx xxxxxx xx xxx xxxxxxxxxxxxxxx xx xxx xxxxxxxxxx xxxx xxxxxxx xx xxxxx xxxxx xx xxx xxxxxre special protection in the State of the commitment;

xxxxxxx xxx xxxxx xxxxxxxxx xxxxx xxxxxxx provision for specific rules concerning the authorization of agencies and branches of undertakings whose head offices are outside the Community;

Article 6
1 . Article 25 of the First Directive is hereby deleted .
2 . 3 . They may require only non-systematic notification of these conditions and other documents, for the xxxxxxx xx xxxxxxxxx xxxxxxxxxx xxxx xxxxx xxxxxxxxxxx xxx xxxxxxxxxxxxxx xxxxxxxxxx xx xxxxxxx xx xxxx xxxxxxxxxxxx xxxxxxxx xxxx xxxxxxxxxxx xxx not constitute a prior condition in order for an undertaking to carry on its activities .
Article 20
1 . Any undertaking providing services shall subxxx xx xxx xxxxxxxxx xxxxxxxxxxx xx xxx xxxxxx xxxxx xx xxxxxxxxx xx xxxxxxxx xxx xxxxxxxxx xxxxxxxxx xx xx xxx xxx xxxxxxxx xx xxxxxxxxxxxx xxxx xxxxxxe, insofar as undertakings established there are also obliged to do so .
2 . If the competent authorities of a Member State establish that an undertakinx xxxxxxxxx xxxxxxxx xxxxxx xxx xxxxxxxxx xxxx xxx xxxxxx xxxx xxx xxxxx xxxxxxxxxx xxxxxxxxxx xx xx xx xxxx xxxxxx xxxx xxxxxxxxxxx xxxxx xxxxxxx xxx xndertaking concerned to put an end to the irregular situation .
3 . If the undertaking in question fails to comply with the request referred to in paragrxxx xx xxx xxxxxxxxx xxxxxxxxxxx xx xxx xxxxx
xxxxx xx xxxxxxxxx xx xxxxxxxx xxxxx xxxxxx xxx xxxxxxxxx xxxxxxxxxxx xx xxx xxxxxx xxxxx xx xxxxxxxxxxent accordingly . The latter authorities shall take all appropriate steps to ensure that the undertaking concerned puts an end to that irregular situatxxx x xxx xxxxxx xx xxxxx xxxxxxxx xxxxx xx xxxxxxxxxxxx xx xxx xxxxxxxxxxx xx xxx xxxxxx xxxxx xx xxxxxxxxx xx xxxxxxxx x

The law applicable to the contract pursuant to Article 4 shall not affect the tax arrangements applicable .
