Whereas plant production is very important to the Community;

xxxxxxx xxx xxxxxxxxxx xx xxxxxx xxxxxxx xxxx xxxxxxxxx is absolutely necessary not only to avoid reduced yields but also to increase agricultural productivity;
Whereas action taken by Member States and axxxx xx xxx xxxxxxxxxx xxxxxxxxxxx xx xxxxxxx xxxxxxxxx xxxxxx xxxxxx xxxxxx xxxxx xxxx xxxx x xxxxxxx xxxxxx xx xxxxxxxxxx xxxxxxxx xxxxxxx xxxxx xxxroduction were not applied at the same time;
Whereas the need for such measures has long been recognized ; whereas they have formed the subject of many nxxxxxxx xxxxxxxxxxx xxx xxxxxxxxxxxxx xxxxxxxxxxxx xxxxxxxxx xxx xxxxxxxxxxxxx xxxxx xxxxxxxxxx xxxxxxxxxx xx x xxxxxxxx xxxx xxxxxxxxx xx xxx xxxted Nations, Food and Agricultural Organization, which is of world-wide interest;
Whereas this International Plant Protection Convention and the xxxxx xxxxxxxxxxx xx xxxxxx xx xxx xxxxxxxx xxx xxxxxxxxxxxxx xxxxx xxxxxxxxxx xxxxxxxxxxxx xxxxx xx x xxxxxxx xxxxxxx xxxxxxx xxxxxxxx xx xxx xxxxxxization of plant-health laws;
Whereas, independently of this international cooperation, closer harmonization of the provisions against the intrxxxxxxxx xx xxxxxxx xxxxxxxxx xxxx xxx xxxxxx xxxxxx xx xxx xxxxxxxxx xx xxxxxxxxx
xxxxxxx xx xx xxxxxxxxx xx xxxx xxxxxx xxxxxxxxxx xxxxxxxxxxxx xxainst the introduction of harmful organisms from non-member countries and also to re-organize plant-health inspection in conjunction with the graduxx xxxxxxx xx xxxxxxxxx xx xxx xxxxxx xx xxxxxxxxxxxxxxx xxxxxx
xxxxxxxx xx xxxx xxxxxxxx xxx xx xxx xxxx xxxxxxxxx xxxxxxxx xxxxxxxx xx xxxxxxx xxx xarticularly dangerous harmful organisms whose introduction into the Member States must be totally prohibited and also the harmful organisms whose inxxxxxxxxxx xxxx xxx xxxxxx xxxxxx xxxx xxxxxxx xx xxxxxxx xxxxxx xx xxxxx xxxxxxxx xxxx xxxx xx xxxxxxxxxxx
xxxxxxx xxx xxxxxxxx xx xxxx xx xxxxx xxxxful organisms, when plants or plant products are introduced from countries in which these organisms occur, cannot be effectively checked ; whereas it ix xxxxxxxxx xxxxxxxxx xx xxxx xxxxxxx xxxxxxxxx xxx xxxx xx xxx xxxxxxxxxxxx xx xxxxxxx xxxxxx xxx xxxxx xxxxxxxxx xx xx xxxxxxx xxx xxxxxxx xxxxxx xx xx made in the producer countries;
Whereas, due to special circumstances, certain other harmful organisms are significant in certain Member States onxx x xxxxxxx xx xx xxxxxxxxxx xx xxxxx xxxxx xxxxxx xxx xxxxxx xx xxxxxxx xxxxx xxxxxxx xxxxxxxxx xx xxx xxxxxxxxx xxxxx xx xxxxx xxxxxxx
xxxxxxx xx xxxra-Community trade, a plant health control currently operates for all plants, plant products and other objects not only in the consignor country but alxx xx xxx xxxxxxx xx xxxxxxxxxxx x xxxxxxx xx xx xxxxxxxxx xx xxxxxxx xxx xxxxxx xxxxxxxx xxxxxxxxx xxxx xx xxxx xxxx xx xxxxxx xxxxx xx xxx xxxxx xx xxxx xxxxxxxxxx xx xxxxxxxx xxxxxxxxxx xxxxxxxxx xx xxxxxxx xxxx xxxx xxxxxxxxx xx xxx xxxxxxal Journal).
consignor country compulsory and more stringent, in order to forestall as far as possible any introduction of harmful organisms into thx xxxxxxx xx xxxxxxxxxxxx
xxxxxxxx xx xxx xxxxxx xx xxx xxxxxxxxxxxx xxxxx xxxx xx xxx xxxxxxxxx xxxxxx xxxxx xx xxxxxxxxxxxxx x xxxxxxxxxxxxx xxxxxficate conforming to the model introduced by the International Plant Protection Convention must generally be issued;
Whereas, in order to avoid any xxxxxxx xxxxxxxxxxx xxxxxxxxx xxxxxxxxx xxxx xx xxxx xxx xxxxxxx xx xxxxxxxxxxxxx xxxxxxxxxxxxx xxxxxxxxxxxx xxxxx xxxxxxx xxxxxxxxxx xxx xxxxxxxments covered by a phytosanitary certificate and coming from other Member States;
Whereas, if a plant-health check carried out in the consignor Membxx xxxxx xxxxxxxxxxx x xxxxxxxxx xxxx xxx xxxxxxxx xxx xxxx xxxx xxxxxxx xxxxxxxxxx xx xx xxxxxxxx xx xxxxxxxx xxxx xxx xxxxxxxxxx xxxxxx xxxxxxx xxx xx the Member State of destination;
Whereas, until confidence is established between Member States regarding the correct operation of inspection sysxxxx xx xxx xxxxxxxxx xxxxxx xxxxxxx xxxxxxxxxx xxxxxx xxx xxxx xx xxxxxxxxx xxxx xxxxxxxxxx
xxxxxxx xx xxxx xxxxxxxx xx xxxxx xxxxxx xxxxxxxxx xxx xystematic checks to continue to be allowed in the country of destination for a period of four years from the notification of this Directive, while all the xxxxx xxxxxxxxxx xx xxxx xxxxxxxxx xxxx xx xxxxxxxxxx xxxx xxxxxxxx xxxx xx xxx xxx xx xxx xxxxxx xxxx xxxxxxxxx xxxx xxxxxxxxxxxxx

xxxxxxx xx xxx xxxxx xxxxx xx xx xxcessary for Member States to require, with regard to introductions of products from non-member countries, checks to be carried out at least on the princxxxx xxxxxxxx xx xxxxxxx xxxxxxxxxx
xxxxxxx xx xx xxxx xxxxxxxxx xx xxxx xxxxxxxxx xxxxx xxxxxxx xxxxxxxxxx xxx xxxxxx xxxxxx xx xx xxxx xx xxxxxx xxxogations from a certain number of provisions;
Whereas Member States must also have the right to take protective measures not laid down in this Directixxx xx xxx xxxx xx xxxxxxxx xxxxxx xx xxx xxxxxxxxxxxx xx xxxxxx xx xxxxxxx xxxxxxxxxx
xxxxxxx xx xxxx xxxx xx xxxxxxxxxxx xx xx xxxxxxxxxxx xxx xxxxxx States to cooperate closely with the Commission within the Standing Committee on Plant Health set up by Decision 76/894/EEC (1);
Whereas the Communixx xxxxxxxxxx xxxxxx xxxx xxxxx xxxxxx xxxxxxxx xxx xxx xx xxxxxxxxx xxxxxxxx xx xxxx xxxxxxxxx x xxxxxxx xxxx xxxx xxxxxxx xx xxx xxxxx xxxxxx xxxxxxxxns laid down by Member States on protection against harmful organisms which generally attack plants or plant products in storage and certain other planx xxxxxx xxxxxxxx xxxx xxxx xx xxxxxx xxxxxx xxxxxxxxxx xxxx xxxxxxxx xxx xxxxxxxx xxxxxxxxx
xxxxxxx xxx xxxxxxxxx xx xxx xxxxxx xxxxxxxx xxxxxxxxxts differs from that in the other parts of the Community owing to the conditions as regards climate, xxxxxxxxxxxx xxxxxxxxxxx xxxxxxx xxxxxxxxx xxx xxxxx xxxxxxxxx xxxxx xx x xxxxx x xxxxxxxx xxx xxx xxxx xxxxx xx xx xxxxxxxxx xxx xxxxxxxx xx xxxxx xxx xrovisions of this Directive to the said departments until they have been suitably adjusted,
HAS ADOPTED THIS DIRECTIVE:
Article 1
1. This Direxxxxx xxxxxxxx xxxxxxxxxx xxxxxxxx xxxxxxx xxx xxxxxxxxxxxx xxxx xxx xxxxxx xxxxxx xxxx xxxxx xxxxxx xxxxxx xx xxxxxxxxxx xxxxxxxxx xx xxxxxxxxx xxxch are harmful to plants or plant products.
2. This Directive shall not apply to the French overseas departments.
Article 2
1. For the purposes ox xxxx xxxxxxxxxx xxx xxxxxx x xxxxx xx xxxxxxxxxx xx xxxx xxxxxx xxxxxx xxx xxxxxx xxxxx xx xxxxxxx xxxxxxxxx xxxxx xxxxx xxx xxxxxx xxxxx xx x xxxx xxxxx1976, p. 25.
(b) plant products : shall be considered to mean products of plant origin, unprocessed or having undergone simple preparation, in so far ax xxxxx xxx xxx xxxxxxx
xxx xxxxxxxx x xxxxx xx xxxxxxxxxx xx xxxx xxx xxxxxxxxx xxx xxx xxxxxxx xx xxxxxx xx xxxxxx xxxxx xxxxxxxxxx xxxxxxx xxxxxxxxxion or propagation;
(d) harmful organisms : shall be considered to mean pests of plants or of plant products, which belong to the animal or plant kingdoxxx xx xxxxx xxx xxxxxxxx xxxxxxxxxxx xx xxxxx xxxxxxxxxx
xxx xxxxxxxx xxxxxxxxx x xxxxx xx xxxxxxxxxx xx xxxx xxxxxxxxx xxxx xx xxxxxxxxxxxxxxx xx xhe official plant-protection organization or, under their responsibility, by other public servants.
2. This Directive concerns wood only in sx xxx xx xx xxxxxxx xxx xx xxxx xx xxx xxxxxxx xxxxx xxxxxxxx xxxx xx xxxxxxx xxxxx
xxxxxxx x
xx xxxxxx xxxxxx xxxxx xxx xxx xxxxxxxxxxxx xxxx xxxxx xerritory of the harmful organisms listed in Annex I, Part A.
2. Paragraph 1 shall not apply during the period 16 October to 30 April in the case of slight cxxxxxxxxxxxx xx xxx xxxxxxx xx xxx xxxxxxx xxxxxxxxx xxxxxxxx xx xx xxxxx xx xxxx x xxx xxx xxx xxxx
xxxxx xxx xxxxxxxxx xxxx xxxx xx xxxxxxx xxx xxxxxx xtates may be authorized on request to shorten the aforesaid period.
3. Paragraph 1 shall not apply in the case of slight contamination of fruit by the haxxxxx xxxxxxxx xxxxxxxx xx xx xxxxx xx xxxx x xxx xxxx xxxxxxxx xxxxxxxxx x xxxxx xxxxx xxxxxx xxx xxxxxx x xxx xx xx xxxxxxxxxx xx xx xxx xx xxxx xxxxxxx xxxanism is young and mobile.
4. Member States shall ban the introduction into their territory of the plants and plant products listed in Annex II, Part A, xxxxx xxxx xxx xxxxxxxxxxxx xx xxx xxxxxxxx xxxxxxx xxxxxxxxx xxxxxx xx xxxx xxxx xx xxx xxxxxx
xx xxxxxx xxxxxx xxx xxx xxx xxxxxxxxxxxx xxxx xxxxx xxrritory of the harmful organisms listed in Annex II, Part A, whether in an isolated state or occurring on objects other than the relevant ones listed in thxx xxxx xx xxx xxxxxx
xx xxx xxxxxx xxxxxx xxxxxx xx xxxxx xx xxxx xx xxx xx xxxxx xxx xxxx xx xxx xxx xxx xxxxxxxxxxxx xxxx xxxxx xxxxxxxxx xxx xxx xxx xxxxful organisms listed in Annex I, Part B, against their names;
(b) the plants and plant products listed in Annex II, Part B, against their names, where thxx xxx xxxxxxxxxxxx xx xxx xxxxxxxx xxxxxxx xxxxxxxxx xxxxxx xx xxxx xxxx xx xxx xxxxxx
xx xxxxxx xxxxxx xxx xxx xxxx xxxx xxx xxxxxxxxxxxx xxxx xxxxx xxxxxxxxx xx xxxxxxxxx xx xx xxxxxxxx xxxxx xxxxx xxxx xxxse listed in Annexes I and II which might be considered harmful shall be prohibited or require special authorization.
Article 4
1. Member States sxxxx xxx xxx xxxxxxxxxxxx xxxx xxxxx xxxxxxxxx xx xxx xxxxxx xx xxxxx xxxxxxxx xxxxxx xx xxxxx xxxx xxxx xx xxxxx xxxx xxxxxxxxx xx xxx xxxxxxxx xxxxxxxxs referred to in that part of the Annex.
2. Member States may: (a) ban the introduction into their territory of the plants, plant products and other objexxx xxxxxx xx xxxxx xxxx xxxx xx xxxxxxx xxxxx xxxxxx
xxx xxxxxxx xx xxx xxxxx xxxxxx xxxxxxx xxxx xxxxx xxx xxxxxx xx xxxxx xxxxxxxx xxxxxx xx xxxxx xxx, Part A, other than those listed in (9) and (10) are introduced into their territory, an official certificate stating the country from which these produxxx xxxxxxxxxx
xxxxxxx x
xx xxxxxx xxxxxx xxxxx xxx xxx xxxxxxxxxxxx xxxx xxxxx xxxxxxxxx xx xxx xxxxxxx xxxxx xxxxxxxx xxx xxxxx xxxxxxx xxsted in Annex IV, Part A, unless the relevant special requirements indicated in that part of the Annex are met.
2. Member States may: (a) lay down that thx xxxxxxx xxxxxxxxxxxx xxxxxx xx xxxxx xxx xxxx x xxxx xxxx xxx xx xxx xxxxx xxxx xxxxx xx xxxxxxxxxx xxxxxxxxx xxx xxxxxxxx xx xxxxxxxx xx xxxx xx xxx xxx xown equivalent conditions for wood originating in the relevant countries described in therein;
(b) ban the introduction into their territory of the xxxxxx xxxxxx xx xxxxx xxx xxxx xx xxxxxxx xxxxx xxxxx xxxxxx xxx xxxxxxxx xxxxxxx xxxxxxxxxxxx xxxxxxxxx xx xxxx xxxx xx xxx xxxxx xxx xxxx
xxx xxxxxxe of the other Member States, from which the plant products listed in Annex IV, Part A (1), (2), (3) or (5) are introduced into their territory, an official xxxxxxxxxxx xxxxxxx xxx xxxxxxx xx xxxxx xxxxx xxxxxxxx xxxxxxxxxx
xxxxxxx x
xx xxxxxx xxxxxx xxxxx xxx xxxxx xx xxxxx xx xxxxxxx xx xxx xxxxoduction into another Member State of the plants, plant products and other objects listed in Annex V, that the latter and their packaging shall be meticuxxxxxx xxxxxxxx xx xx xxxxxxxx xxxxxx xxxxxx xx xxxxx xxxxxxxx xx xx xxxxxxxxxxxxxx xxxxxxx xxx xxxxx xx xxxxxxxxxx xxx xxxxxxxx xxxxxxxxxxxx xxxx xxxll also be officially examined in order to make sure: (a) that they are not contaminated by the harmful organisms listed in Annex I, Part A;
(b) in the casx xx xxx xxxxxx xxx xxxxx xxxxxxxx xxxxxx xx xxxxx xxx xxxx xx xxxx xxxx xxx xxx xxxxxxxxxxxx xx xxx xxxxxxxx xxxxxxx xxxxxxxxx xxxxxx xx xxxx xxxx xx xxx xxnex;
(c) in the case of the plants, plant products and other objects listed in Annex IV, Part A, that they comply with the relevant special requirements xxxxxxxxx xx xxxx xxxx xx xxx xxxxxx
xx xxxxxx xxxxxx xxxxx xxx xxxx xxx xxxxxxxxxx xxxxxxxx xxxxxxxx xx xx xxxxxxxxx x xx xxxxx xx xxxxxx xxxxxxxxce with Article 3 (5), (6) and (7) or Article 5 (2), where the Member State of destination avails itself of one of the options listed in the abovementioned Axxxxxxxx
xx xxxxxx xxxxxx xxxxx xxx xxxx xxxx xxx xxxxx xxxxxxxx xx xx xxxxx xxx xxxx xx xxxxx xxx xx xx xxxxxxxxxx xxxx xxxxxxx xxxxxx xxxxx xxxxx xx xxxxxxxxxx examined in order to make sure that they comply with the relevant special requirements listed in that part of the Annex.
Article 7
1. Where it is conxxxxxxxx xx xxx xxxxx xx xxx xxxxxxxxxxx xxxx xxxx xx xxxxxxx xx xxxx xxx xxxxxxxxxx xxxxxxx xxx xxxxxxxxxx x xxxxxxxxxxxxx xxxxxxxxxxx xxxxx xx xxxxxx in accordance with the specimen in Annex VIII, Part A, drawn up in at least one of the official languages of the Community, preferably that of the Member Stxxx xx xxxxxxxxxxxx xxx xxxxx xxxxxxxx xxx xxxxx xxxxxxxxxxxx xx xxxxx xxxxxxxx xxxxxxxxxxxxxxx xxxxx xx xxxxxxxx xx xxx xxxxxxxxxxx xx xxx xxxxx xxxxt;objects described".
2. Member States shall lay down that the plants, plant products and other objects listed in Annex V may not be introduced ixxx xxxxxxx xxxxxx xxxxx xxxxxx xxxx xxx xxxxxxxxxxx xx x xxxxxxxxxxxxx xxxxxxxxxxx xxxxxx xx xxxxxxxxxx xxxx xxxxxxxxx xx xxx xxxxxxxxxxxxx xxxxxxxcate may not be made out more than 14 days before the date on which the plants, plant products or other objects leave the consignor Member State.
3. The acxxxx xx xx xxxxx xx xxx xxxxxx xxxxxx xx xxxxx xx xxxxxxxxx xxxxxxx x xxx xxxxx xx xxxxxxxxxx xx xxxxxxxxxx xxxx xxx xxxxxxxxx xxxx xxxx xx xxxxxxx xx xxxxxe expiry of the period referred to in Article 20 (1) (b).
Article 8
1. Unless one of the eventualities provided for in paragraph 2 arises, Member Staxxx xxxxx xxx xxxx xxxx xxx xxxxxxx xxxxx xxxxxxxx xxx xxxxx xxxxxxx xxxxxx xx xxxxx x xxxxx xxxx xxxx xxxxxxxxxx xxxx xxxxx xxxxxxxxx xxxx x xxxxxx xxxxx and which are to be introduced into the territory of another Member State shall be exempted from a further inspection complying with Article 6, if they arx xxxxxxxxxxx xx x xxxxxxxxxxxxx xxxxxxxxxxx xxxx x xxxxxx xxxxxx xxxx xxx xx xxxxxxxxxx xxxx xxx xxxxxxxx xx xxxxx xxxxx xxxx xx
xx xxxxx xxxxxxx xxxxt products or other objects from a Member State have been split up or stored or their packaging changed in a second Member State and are then introduced intx x xxxxx xxxxxx xxxxxx xxx xxxxxx xxxxxx xxxxx xxxxx xx xxxxxxxx xxxx xxxxxx x xxx xxxxxxxxxx xxxxxxxxx xxxx xxxxxxx x xx xx xx xxxxxxxxxx xxxxxxxxxxx xxat no change in these products has occurred in its territory which would involve non-compliance with the conditions laid down in Article 6. In this case a xxxxxxxxxxxxx xxxxxxxxxxxxx xxxxxxxxxxx xx xxxxxxxxxx xxxx xxx xxxxxxxx xx xxxxx xxxxx xxxx xx xxxxx xx xx xx xxxxx xxx xxxxxxxx xxxxxxxxx xxxxxxxxx xreferably that of the Member State of destination, shall be issued. This certificate must be attached to the phytosanitary certificate issued by the fixxx xxxxxx xxxxx xx xx x xxxxxxxxx xxxx xx xxx xxxxxx xxxxxxxxxxxx xxxx xxxxxxxxxxx xxx xx xxxxxxxx xxxxxxxxxxxxxxxxxxx xxxxxxxxxxx xxx xxxxxxxxxxxxot;.
The re-forwarding phytosanitary certificate may not be made out more than 14 days before the date on which the plants, plant products or other objxxxx xxxxx xxx xxxxxxxxxxxxx xxxxxxxx
xx xxxxxxxxxx x xxx x xxxxx xxxx xxxxx xxxx xxxxxxx xxxxx xxxxxxxx xx xxxxx xxxxxxx xxx xxxxxxxxxx xxxxxxxxxxxy into several Member States. Article 10

Member States shall lay down that the phytosanitary certificates or re-forwarding phytosanitary certificates produced when the plants, xxxxx xxxxxxxx xx xxxxx xxxxxxx xxx xxxxxxxxxx xxxx xxxxx xxxxxxxxx xxxxx xxxx xx xxxxx xxxxx xxxx xxx xxxxxxxxx xxxxxxxxxxxx xxxxxxx xx xxxxx xxx xxxx of the organization and the date of entry.
Article 12
1. 2. Paragraph 1 shall apply to the cases referred to in Articles 6 (3) and 7 (3).

2. In accordance with the procedure laid down in Article 16, and no later than six months after axxxxxxx xx xxx xxxx xxxxxxxxxxx x xxxxxxxx xxx xx xxxxx xx xxxxxxx xxxx xxxxxx xx xxxxxxxxx xx xxxxxxxx

Article 15
1. It shall immediately inform the other Member States and the Commission of the measures taken and indicate the reasons for them.
2. 4. Where the measures are in accordance with the opinion of the Committee, the Commission shall adopt them and shall implement them forthwith.
